TERMS AND CONDITIONS "MONSTER-MANIA Raffle"
I. General
1. The Monster-Mania Raffle is a raffle organised by HEAD Sport GmbH, Wuhrkopfweg 1, 6921 Kennelbach, Austria ("HEAD") that runs from the 1st of April, 2024, until the 30th of September, 2024. (“Raffle”).
2. This Raffle is a public raffle. HEAD will also report publicly about the Raffle.
Unless provided otherwise herein this Raffle is free of charge and is only subject to the present Terms & Conditions (“T&C”) and to all applicable laws and regulations.
By entering and participating in the Raffle you agree that your child may take part in the Raffle and that you are bound by these T&C and represent that you and your child satisfy all of the eligibility requirements below. If you do not agree to these T&C, you, and your child respectively, may not participate in the Raffle.
II. Raffle process and selection of winners
1. The Raffle begins on the 1st of April, 2024, and ends on the 30th of September, 2024 (“Term”). The completed entry form from the Monster-Mania stamp booklet has to be sent via postal service to HEAD (address see point II.4) on 15th October 2024 (postal stamp date) at the latest. The winners will then be drawn at random (see also point II.6 below).
2. In order to participate you need to reside in one of the following countries:
Germany, Austria, Switzerland, France, Spain, Andorra, Portugal, Poland, United Kingdom, Czech Republic, Sweden, Finland, Norway, Denmark, Belgium, Netherlands, Greece, Hungary, Luxembourg or Liechtenstein.
People from other countries cannot participate.
Subject to the above, everyone who is not excluded from the Raffle according to clause II./3 of these T&C, may participate in the Raffle. Minors may only participate, if a legal guardian has agreed to the minor’s participation beforehand. If we find out that a minor has registered for the Raffle without their legal guardian’s prior consent, we will promptly delete all data submitted to us and exclude the minor from the Raffle.
3. The following people are excluded from participation in the Raffle:
HEAD employees and their families, and the employees and families of partners of HEAD, who are involved with the design, organization and implementation of this Raffle.
4. Participation in the Raffle is only possible by sending the completed entry form from the Monster-Mania stamp booklet (p. 22) by post to HEAD Sport GmbH, Wuhrkopfweg 1, A-6921 Kennelbach.
Confirm that you accept these Terms and Conditions and that your child may enter the Raffle by ticking the box.
5. Your child may only enter the Raffle once. Even if you enter your child more than once, they will only be given a single participation in this Raffle. This Raffle is not linked to your child’s tennis club and is not sponsored, endorsed or administered by the tennis club. HEAD disclaims any liability should you and your child fail to comply with these T&C.
6. The winners will be randomly drawn after October 15th 2024 and will be contacted no later than the 30th of October, 2024. You may reject any prize on behalf of your child. If you do not confirm the acceptance of the prize on behalf of your child within 3 days after receiving the notification of winning mentioned in this clause II.6, the notification will be without effect and the prize will be withdrawn. In this case HEAD reserves the right to determine alternative winners by conducting subsequent random drawings until the required number of winners are determined. The same applies if you reject the prize on behalf of your child.
7. The prizes:
There will be three prize winners, selected at random, who will each win one Head to toe HEAD packages:
- One junior racquet of your choice, one pair of shoes, one sweatshirt, one t-shirt, one pair of shorts
8. Once you have accepted the prize on behalf of your child, HEAD will delivered it to you/your child by courier/mail. HEAD bears the delivery cost of the prizes, however, all other potential costs related to winning a price, such as any taxes or duties shall be borne by you.
9. HEAD reserves the right to replace any or all prizes with prizes of a similar value.
10. No cash alternatives will be provided and prizes are not exchangeable, non‐transferable and non‐refundable.
11. HEAD does not accept any liability for errors in the submission and transmission of submissions. HEAD does not accept any responsibility for registrations that are lost, arrive late, are illegible, incomplete, damaged, or invalid in any other way.
12. The Raffle will be run at HEAD´s sole discretion. HEAD’s decision in relation to all matters in connection with the Raffle is final, and no correspondence will be entered into.
13. The recourse of the courts is excluded.
III. Data protection
1. You acknowledge and agree that your, and your child’s personal data will be processed by HEAD (Controller) for the purpose of organizing and conducting the Raffle (e.g. to contact selected winners) as described in detail in clauses II and III of these T&C and in accordance with our Privacy Policy.
2. This data might also be transmitted to official partners inside and outside of the European Union to support performance of the Raffle (e.g. carrier for delivery of prize, other members of the HEAD group for administrative purposes). If the personal data is processed in a country that does not have a recognized level of data protection such as the European Union, we will use contractual or other recognized means to ensure that such personal data is properly protected.
3. Your and/or your child’s personal data will be deleted or anonymized after the following period:
- Mere participants and selected winners: six months after the end of the Raffle,
- Winners: seven years after the receipt or consumption of the prize,
- In any case: if applicable until the expiry of the guarantee, warranty, limitation and statutory retention periods valid for us and/or beyond this until the ending of any legal disputes in which the data are required as evidence.
4. You and your child have the right to information over the personal data stored, deletion and correction of the data saved concerning your or your child’s person, withdrawal of consent to processing of your or your child’s personal data, data portability, object to processing of your or your child’s personal data, to lodge a complaint with the competent supervisory authority. To exercise any of those rights you may send an inquiry to privacy@head.com indicating which right you are referring to.

IV. Liability and Warranty
1. You are herewith informed that for the prize the same warranty and operational provisions will be applicable as for products sold by retailers. However, HEAD shall not be liable for anything additionally.
V. Place of jurisdiction and applicable law
1. These T&C are exclusively subject to the laws of the Republic of Austria, provided this does not contravene any compulsory legislation.
2. Any legal issues that arise in connection with the performance of and participation in this Raffle will exclusively be dealt with by the relevant courts in the place of jurisdiction of the HEAD headquarters, provided this does not contravene any compulsory legislation. HEAD may however also elect to apply to the courts of the residence of the participant.
3. If any clauses of these T&C should prove wholly or partially invalid, the validity of the remaining clauses will not be affected.
