TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY REGISTERING FOR CLUB HEAD, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, PLEASE DO NOT REGISTER FOR CLUB HEAD.
SCOPE
These Terms and Conditions apply to your access to and participation in Club HEAD in the European Union, the United Kingdom, Norway, Liechtenstein, Switzerland, Monaco, Australia, the United States and Canada (the "Program"), which is operated by Head Sport GmbH, Wuhrkopfweg 1, 6921 Kennelbach, Austria, company number 64824 f, email: service@shop.head.com, telephone number: +43 5574 608 0, VAT ID: ATU 36741905, or its respective subsidiaries and affiliated companies (collectively "HEAD").

These Terms and Conditions do not alter the terms or conditions of any other agreement you may have with HEAD for other products or services.
AMENDMENT OF TERMS AND CONDITIONS
HEAD may change these Terms and Conditions at any time if:
(a) we need to make changes to the systems, technology or other processes used in connection with the Program, which are required or recommended to protect users and ensure security; or
(b) there is a change in an applicable law or regulation or an industry code we follow, or a court, regulator or ombudsman issues a decision that we are required to implement.
If HEAD wishes to change these Terms and Conditions for any other reason, we will notify you of the proposed changes via the email address you have provided at least 30 days in advance. We will also post the proposed changes here: https://www.head.com/club-head. The notifications will explain how you can object to the proposed changes and the consequences of objection. If you do not object to the proposed changes by the relevant deadline, you will be deemed to have accepted them and the new Terms and Conditions will apply immediately after the deadline has passed. If you object to the proposed changes by the relevant deadline, you will be deemed to have rejected them and the existing Terms and Conditions will continue to apply. You hereby agree to this procedure.

PERSONAL USE
The Program is intended for personal use only. Commercial use is prohibited.
If you reside in the European Union, you must be at least 18 years of age to join the Program. If you reside outside the European Union, you must be at least the age of legal majority in the country or state in which you reside to join the Program.
People under 18 years of age or any other applicable age of legal majority require permission from a parent or legal guardian to join the Program. If you reside in the United States and are between 13 and 18 years of age, you may access and participate in the Program only under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions. The Program is not targeted towards nor intended for use by anyone in the United States under 13 years of age.
Employees, officers, directors, agents and representatives of HEAD (collectively "HEAD Participants") are eligible to join the Program but may not be given access to all benefits made available under the Program. Whether HEAD Participants are given access to a benefit will be determined by HEAD in its sole discretion, provided that all HEAD Participants who have accrued the same value will be treated equally.
HEAD reserves the right to refuse any application to join the Program without providing any reason and to change the criteria for joining the Program at any time.
ABOUT THE PROGRAM
HEAD uses the Program to thank and reward customers who purchase HEAD products online at www.head.com. Members of the Program will be given access to benefits such as free shipping, gifts, early access to new products and exclusive offers, as determined by HEAD from time to time in its sole discretion.
JOINING AND LEAVING THE PROGRAM
To join the Program, go to https://www.head.com/customer/account/login, follow the prompts to create a customer account and tick the box marked "Terms & Conditions". You will be required to provide your first and last name, email address, shipping address and password. You will also be required to confirm that you are at least 18 years of age or any other applicable age of legal majority, or that your parent or legal guardian consents to your participation in the Program. You may additionally provide your date of birth (day and month) to receive birthday offers. If you do not provide your date of birth, you will not receive benefits relating to your birthday.
If you already have a customer account, you can join the Program by accessing your account, ticking the box marked "Terms & Conditions" and providing the information set out above, to the extent not already provided.
After registering for the Program, you will receive an email to the email address you have provided asking you to confirm your registration. After you have confirmed your registration, your membership will be activated.
You must inform HEAD of changes to your email address to ensure we have a direct way of communicating with you. You can change your email address by sending email to service@shop.head.com.
You can deregister from the Program at any time by deleting your customer account or by writing to us at service@shop.head.com. If you deregister from the Program, your customer account will be deactivated immediately (or within two business days if you sent us an email with your request to deregister from the Program). Following deregistration, your entire customer account will be permanently deleted at which point all value accrued becomes void.
BENEFITS
You become entitled to receive benefits under the Program once you successfully activate your membership. You can earn the right to receive benefits by purchasing HEAD products online at www.head.com. Only purchases you make after you join the Program will be taken into account.
You will be allocated benefits depending on your value balance, as determined by HEAD from time to time in its sole discretion. Your value balance is based on the total value of the products you have purchased on www.head.com and your interests.
The value of a product will be calculated in the currency of purchase on the date of purchase and does not include shipping and handling fees, gift wrapping fees, donations or taxes. The value of a purchase will be added to your value balance 30 days after delivery.
The value of the benefits you receive as part of the Program will not be counted towards your value balance. If you purchase a product using a gift voucher, the value of the gift voucher will not be counted towards your value balance.
ACCESSING BENEFITS
The time at which benefits are made available, the type of the benefit made available and the number of benefits made available will be determined by HEAD in its sole discretion, provided that all members of the Program with the same value balance will be given access to the same benefits at the same time.
Benefits may include the following:
1. Free delivery
2. Gifts or giveaways
3. Early, exclusive or extended access to sales and discounts
4. Early or exclusive access to new products or collaborations
5. Access to events
6. Birthday gifts (if you provided your date of birth upon registration)

OTHER IMPORTANT INFORMATION REGARDING YOUR MEMBERSHIP
There are no participation or membership fees associated with the Program.
Access to benefits under the Program cannot be combined with any other offer or discount unless otherwise expressly indicated by HEAD. Benefits may not be redeemed for cash.
Your customer account and membership of the Program are personal to you and may not be sold, transferred or assigned to family, friends or others.
You may have only one customer account. HEAD may in its sole discretion suspend, cancel or combine customer accounts that are duplicative.
TERMINATION
Ordinary Termination
You may terminate the contractual relationship with HEAD at any time without notice by deleting your customer account or by contacting us at service@shop.head.com. Your customer account will be deactivated immediately (or within two business days if you sent us an email with your request to deregister from the Program). Following, you will no longer have access to the Program. In such cases, the section "Joining and Leaving the Program" applies.
HEAD may terminate the contractual relationship with you without providing any reason, provided we give you not less than three months' notice. You will continue to have access to the Program and your customer account until termination, at which point all value accrued becomes void and you will no longer have access to the Program/your customer account.
HEAD may also deregister and delete any customer account that has been inactive for at least 36 consecutive months, provided we give you not less than four weeks' notice. Inactivity is defined as no product purchased on www.head.com during such 36-month period. You will continue to have access to the Program and your customer account until deregistration, at which point all value accrued becomes void and you will no longer have access to the Program/your customer account.
Extraordinary Termination (Termination for Good Cause)
Without notice to you, HEAD may suspend or terminate your customer account if we reasonably determine that you have violated these Terms and Conditions or that your use of the Program is unauthorised, deceptive, fraudulent or otherwise unlawful. In such cases, you will receive a notification and information on how to appeal the decision. If your customer account is terminated by HEAD for one of these reasons, all value accrued immediately becomes void.
Program Termination
HEAD may discontinue or cancel the Program without providing any reason. In such cases, we will inform you not less than three months prior to the end of the Program. You will continue to have access to the Program until termination, at which point all value accrued becomes void and you will no longer have access to the Program/your customer account.
LIABILITY
HEAD does not accept any responsibility or liability for any loss or damage you may suffer in connection with your participation in the Program, including loss or damage arising as a result of technical problems occurring in connection with such participation or your use of www.head.com, or loss or damage suffered in connection with your use or exploitation of any benefit made available under the Program, except for liability arising as a result of gross negligence, wilful misconduct, breach of primary contractual obligations, breach of applicable product liability laws and personal injury.
DISPUTE RESOLUTION
You may bring any dispute which may arise under these Terms and Conditions either to the competent court in Austria or to the competent court in your country of habitual residence at your discretion and this court shall be (to the exclusion of any other court) competent to settle such dispute. HEAD will bring any dispute which may arise under these Terms and Conditions to the competent court of your country of habitual residence.
GOVERNING LAW
These Terms and Conditions and your access to or participation in the Program are governed by the laws of Austria. The United Nations Convention on Contracts for the International Sale of Goods and the referral norms of private international law do not apply, with the restriction that mandatory provisions of the law of the country in which you habitually reside are not suspended.
