TERMS AND CONDITIONS FOR THE “GIVEAWAY TIME: SKI & SPA ESCAPE” (THE “Competition”)

§1 ELIGIBILITY

1.1 You acknowledge that You are at least 18 years of age (or over the age of majority for Your jurisdiction if higher) at the time of participation and You have read and agreed to these Terms & Conditions.

1.2 Please note that HEAD is not liable in case Participants are not legally allowed to take part in the Competition due to national or local laws.

1.3 HEAD employees and their families, and the employees and families of partners of HEAD, who are involved with the design, organisation and implementation of this Competition, are excluded from participation in this Competition.

1.4 In order to participate you need to reside in one of the following countries: Germany, Austria, Switzerland, France, Spain, Andorra, Portugal, Poland, United Kingdom, Czech Republic, Sweden, Finland, Norway, Denmark, Belgium, Netherlands, Greece, Hungary, Luxembourg or Liechtenstein. People from other countries cannot participate.

§2 GIVEAWAY PERIOD

2.1 This Competition starts on Nov 30 2025, 17:00 CET and ends on December 3rd, 23:59 CET (“Competition Period”). Entries received thereafter will not be considered.

§3 RULES OF THE COMPETITION AND OF PARTICIPATION

3.1 The participation in this Competition is only possible on Instagram (“Platform”). For participation in this Competition, an account on the Platform is required. Participants may only take part in the Competition from a single profile on the Platform. Even if You try to participate more than once in this Competition, You will only be given a single participation in this Competition. This Competition is not linked to the Platform and is not sponsored, endorsed or administered by, or associated in any way with the Platform. Your use of the Platform is subject to the Platform’s Terms of Use; for details, please see here. HEAD disclaims any liability should You fail to comply with the Platform’s Terms of Use.

3.2 In order to participate in this Competition, You need to complete these three (3) steps within the Competition Period and need to maintain this status until a winner is drawn:
a) Follow the Instagram accounts @head_ski @tauernspa and @kitzsteinhorn_official,
b) Like the post of the Competition provided on the @head_ski @tauernspa and @kitzsteinhorn_official Instagram channels marked “GIVEAWAY TIME: SKI & SPA ESCAPE”
c) Tag a friend you’d take on this ski & spa adventure. By tagging others, you confirm that you have obtained their consent to be mentioned/tagged in your comment.

Please also make sure that Your account on the Platform is publicly available so that it is possible to contact You in case You get drawn as a winner. Only by following all steps of the described procedure, You will be eligible to enter the Competition.

3.3 HEAD takes no responsibility for the actions of the Participant in the giveaway process. Especially if other accounts get mentioned (tagged), HEAD takes no responsibility for the compliance of third parties or any Participant. No comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory, or that could violate the rights of third parties, will be allowed. If it becomes evident that any of the Participants have not met the requirements of these Terms and Conditions, or that the data provided for participation is not valid, the participation is considered null and void and the Participant will automatically be excluded from the Competition, losing all rights to the prize(s) on offer in the Competition. HEAD reserves the right to determine alternative winners by conducting subsequent random drawings until the required number of winners is determined.

3.4 By entering, each Participant warrants and represents the following with respect to his/her Submission: (a) Participant has all rights to submit his/her Submission; (b) the Submission will therefore not infringe on any rights of any third parties; and (c) any third parties appearing in the Submission have given Participant appropriate consent (consent of legal guardians if applicable) for the respective use.

§4 THE SELECTION PROCESS

4.1 Entries close on December 3rd, 23:59 CET, and the winner will be selected by chance from the pool of all correct entries made until then.

4.2 The winner of this Competition will be informed on the Platform via direct messaging within 7 days. Any information required for HEAD to conduct this Competition shall also be provided via direct message on the Platform.

4.3 If You are drawn as the winner, we will ask you to provide Your full name, e‐mail address and phone number. The contact details You provide will be used to arrange delivery of the prize package, so please make sure they are correct.

4.4 HEAD undertakes to use reasonable efforts to maintain adequate hardware and software service for the Competition and shall not be liable for: late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, delays or difficulties; errors in transmission; prize notification deliveries attempted but not received; any loss suffered by anyone who enters or attempts to enter the Competition, whether the entry is lost, not submitted, wrongly processed or does not win.

§5 THE PRIZE

5.1 One (1) winner will be selected. The winner will receive the following prize package:

One (1) new pair of skis from HEAD (not rental skis, model and size selected by the winner, subject to availability)

Two (2) nights at TAUERN SPA Zell am See–Kaprun for the winner and one (1) guest of their choice, including:
o Accommodation in one (1) double room
o Daily breakfast for two (2) people
o Full access to all spa areas (20,000 m² of spa water & sauna world, as well as both hotel spas). (subject to room availability)

Two (2) ski passes for the Kitzsteinhorn Glacier for one (1) day, valid for the winner and their guest (exact date selected by the winner) Any additional costs — including but not limited to travel, transfers, meals (beyond stated inclusions), insurance, equipment rental, minibar, spa treatments, tourist taxes, and personal expenses — are not included and must be covered by the winner and their guest. The prize is limited strictly to the items listed above.

5.2 HEAD reserves the right to replace the prize with a prize of a similar value.

5.3 A winner may reject any prize awarded to him/her.

5.4 No cash alternatives will be provided, and the prize is not exchangeable, non‐transferable and non‐refundable.

5.5 In case the winner does not claim his/her prize within 7 days of notification, he/she will have forfeited the prize and HEAD reserves the right to determine an alternate winner based on a second selection by chance.

5.6 The Competition will be run at HEAD’s sole discretion. HEAD’s decision in relation to all matters in connection with the Competition is final, and no correspondence will be entered into.

5.7. The recourse of the courts is excluded.

§6 COLLECTION OF INFORMATION & DATA PROTECTION

6.1 General: HEAD („Controller“) hereby provides notice that all personal data mentioned under Section 3 and 4 of these Terms and Conditions, a well as any other personal data provided during the course or in connection with this Competition (e.g. full name, Instagram use name, email address, phone number) will be processed by HEAD for the purpose of organizing and conducting the Competition (e.g. to contact the winner).

6.2 Transmission: The personal data might also be transmitted to third parties involved in the performance of our contract (e.g. other members of the HEAD Group for administrative purposes – for details please see https://www.head.com/en/locations) inside and outside of the European Union for the purposes mentioned above in accordance with applicable data protection laws. If the personal data is processed in a country that does not have a recognized level of data protection such as the European Union, HEAD will use contractual or other recognized means to ensure that the personal data is properly protected.

6.3 Duration of storage: Personal data will solely be processed for the performance of the Competition and therefore for the purpose of contractual performance. HEAD will delete personal data of the winners after 7 years after the end of the Competition or if applicable until the expiry of the guarantee, warranty, limitation and statutory retention periods valid for HEAD and/or beyond this until the ending of any legal disputes in which the data are required as evidence.

6.4 Individual rights: Participants have the right to information over their personal data stored, deletion and correction of the data saved concerning that person, withdraw their consent to processing of their personal data, if any such consent was given and data portability. Participants also have the right to object to the processing of their personal data. To exercise any of those rights Participants may send an inquiry to privacy@head.com indicating which right they are referring to. Furthermore, Participants have the right to lodge a complaint with the competent supervisory authority.

6.5 Obligations of the Participant: The Participant hereby expressly assures that personal data (including pictures of third parties) will only ever be transferred to HEAD in accordance with the applicable national and European data protection laws. The Participant warrants that before disclosing personal data of any other third party, he/she will ensure that such third party has received all the information on data protection contained in these General Terms and Conditions.

§ 7 PLACE OF JURISDICTION AND APPLICABLE LAW

7.1 These Terms and Conditions are exclusively subject to the laws of the Republic of Austria, provided this does not contravene any compulsory legislation.

7.2 Any legal issues that arise in connection with the performance of and participation in this Competition will exclusively be dealt with by the relevant courts in the place of jurisdiction of the HEAD headquarters, provided this does not contravene any compulsory legislation. HEAD may however also elect to apply to the courts of the residence of Participant.

7.3 If any clauses of these Terms and Conditions should prove wholly or partially invalid, the validity of the remaining clauses will not be affected.
