TERMS AND CONDITIONS FOR SKIING WITH AKSEL TICKETS (THE “COMPETITION”)

This Competition is run from 26th of October 2022, 12:00 CET until 28th of October 2022, 23:59 CET by Head Sport GmbH (“HEAD”), whose registered office is located at Wuhrkopfweg 1, 6921 Kennelbach, Austria (“Competition”).

Unless provided otherwise herein, this Competition is free of charge and is only subject to the present Terms & Conditions and to all applicable laws and regulations.

By entering and participating in this Competition, you ("Participant", or “You”) agree to be bound by these Terms & Conditions and represent that You satisfy all of the eligibility requirements below. If participants do not agree to these Terms & Conditions, they may not participate in the Competition.

§1 ELIGIBILITY

1.1 You acknowledge that You are at least 18 years of age (or over the age of majority for Your jurisdiction if higher) at the time of participation and You have read and agreed to these Terms & Conditions.
1.2 Please note that HEAD is not liable in case Participants are not legally allowed to take part in the Competition due to national or local laws.
1.3 HEAD employees and their families, and the employees and families of partners of HEAD, who are involved with the design, organisation and implementation of this Competition, are excluded from participation in this Competition. Also Italian and Canadian residents are not allowed to participate in this Competition due to local restrictions.

§2 COMPETITION PERIOD

This Competition starts on 26th of October 2022, 12:00 CET until 28th of October 2022, 23:59 CET (“Competition Period”). Entries received thereafter will not be considered.

§3 RULES OF THE GAME AND OF PARTICIPATION

3.1 The participation in this Competition is only possible on Instagram (“Plattform”). For the participation in this Competition, an account on the Plattform is required. Participants may only take part in the Competition from a single profile on the Plattform. Even if You try to participate more than once in this Competition, You will only be given a single participation in this Competition. This Competition is not linked to the Plattform and is not sponsored, endorsed or administered by, or associated in any way to the Plattform. Your use of the Plattform is subject to the Plattform’s Terms of Use, for details please see here. HEAD disclaims any liability should You fail to comply with the Plattform’s Terms of Use.
3.2 In order to participate in this Competition, You need to complete these 3 steps:
a) Follow the Instagram account @head_ski until the winner is drawn,
b) Like the post of the Competition and
c) Tag 1 (one) of your friends that you would liketo go skiing with you and Aksel Lund Svindal.
Please also make sure that Your account on the Plattform is publicly available so that it is possible to contact You in case You get drawn as a winner. Only by following all steps of the described procedure, You will be eligible to enter the Competition.
3.3 HEAD takes no responsibility for the actions of the Participant in the giveaway process. Especially if other accounts get mentioned (tagged), HEAD takes no responsibility for the compliance of third parties or any Participant. No comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory, or that could violate the rights of third parties, will be allowed. If it becomes evident that any of the Participants have not met the requirements of these Terms and Conditions, or that the data provided for participation is not valid, the participation is considered null and void and the Participant will automatically be excluded from the Competition, losing all rights to the prize(s) on offer in the Competition. HEAD reserves the right to determine alternative winners by conducting subsequent random drawings until the required number of winners is determined.
3.4 By entering, each Participant warrants and represents the following with respect to his/her Submission: (a) Participant has all rights to submit his/her Submission; (b) the Submission will therefore not infringe on any rights of any third parties; and (c) any third parties appearing in the Submission have given Participant appropriate consent (consent of legal guardians if applicable) for the respective use.

§4 THE SELECTION PROCESS

4.1 Entries close on 28th of October 2022, 23:59 CET and the winner will be selected by chance from the pool of all correct entries made until then.
4.2 The winner of this Competition will be informed on the Plattform via direct messaging within 7 days. Any information required for HEAD to conduct this Competition (e.g. delivery address of winner) shall be also provided via direct message on the Plattform.
4.3 If You are drawn as winner, please wait for our message and then answer by sending us Your full name, e‐mail address, phone number and the shipping address You wish the prize to be delivered to. The contact details that You provide will be used to notify You and deliver the prize, so please make sure they are correct.
4.4 HEAD undertakes to use reasonable efforts to maintain adequate hardware and software service for the Competition and shall not be liable for: late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, delays or difficulties; errors in transmission; prize notification deliveries attempted but not received; any loss suffered by anyone who enters or attempts to enter the Competition, whether the entry is lost, not submitted, wrongly processed or does not win.
§5 THE PRIZE
5.1 There will be one winner who will receive 2 tickets for a skiing day with Aksel Lund Svindal on 06th November 2022 in Kaprun, consisting of a half day of skiing (morning until noon) and a joint lunch..
The prize will be delivered either via email or direct message to the respective email address we will receive from the winner of the Competition. The delivery costs for the prize will be borne by HEAD. HEAD will cover the costs for lunch as well as the tickets for skiing. All other costs, including but not limited to possible travel expenses, are to be borne by Winner.
5.2 HEAD reserves the right to replace the prize with a prize of a similar value.
5.3 A winner may reject any prize awarded to him/her.
5.4 No cash alternatives will be provided and the prize is not exchangeable, non‐transferable and non‐refundable.
5.5 In case the winner does not claim his/her prize within 7 days of notification, he/she will have forfeited the prize and HEAD reserves the right to determine an alternate winner based on a second selection by chance.
5.6 The Competition will be run at HEAD’s sole discretion. HEAD’s decision in relation to all matters in connection with the Competition is final, and no correspondence will be entered into.
5.7. The recourse of the courts is excluded.

§6 COLLECTION OF INFORMATION & DATA PROTECTION

6.1 General: For further information and details regarding data processing please see our Privacy Policy. HEAD („Controller“) hereby provides notice that all personal data mentioned under Section 3 and 4 of these Terms and Conditions will be processed by HEAD for the purpose of organizing and conducting the Competition (e.g. to ship the prize).
6.2 Transmission: The personal data might also be transmitted to third parties involved in the performance of our contract (e.g. carrier for delivery of mail, other members of the HEAD UK Group for administrative purposes – for details please see here) inside and outside of the European Union for the purposes mentioned above in accordance with applicable data protection laws. If the personal data is processed in a country that does not have a recognized level of data protection such as the European Union, HEAD will use contractual or other recognized means to ensure that the personal data is properly protected.
6.3 Duration of storage: Personal data will solely be processed for the performance of the Competition and therefore for the purpose of contractual performance. HEAD will delete personal data of the winners after 7 years after the end of the calendar year, in which the prize was awarded or if applicable after the expiry of the guarantee, warranty, limitation and statutory retention periods valid for HEAD and/or beyond this until the ending of any legal disputes in which the data are required as evidence.

6.4 Individual rights: Participants have the right to information over their personal data stored, deletion and correction of the data saved concerning that person, withdraw their consent to processing of their personal data, if any such consent was given and data portability. Participants also have the right to object to the processing of their personal data. To exercise any of those rights Participants may send an inquiry to privacy@head.com indicating which right they are referring to. Furthermore, Participants have the right to lodge a complaint with the competent supervisory authority.

6.5 Obligations of the Participant: The Participant hereby expressly assures that personal data (including pictures of third parties) will only ever be transferred to HEAD in accordance with the applicable national and European data protection laws. The Participant warrants that before disclosing personal data of any other third party, he/she will ensure that such third party has received all the information on data protection contained in these General Terms and Conditions and has given its consent to all operations that may require such consent.

§7 PLACE OF JURISDICTION AND APPLICABLE LAW

7.1 These Terms and Conditions are exclusively subject to the laws of the Republic of Austria, provided this does not contravene any compulsory legislation.
7.2 Any legal issues that arise in connection with the performance of and participation in this Competition will exclusively be dealt with by the relevant courts in the place of jurisdiction of the HEAD headquarters, provided this does not contravene any compulsory legislation. HEAD may however also elect to apply to the courts of the residence of Participant.
7.3 If any clauses of these Terms and Conditions should prove wholly or partially invalid, the validity of the remaining clauses will not be affected.
